laws of that state.
Everyone doing anything outside
Canada that would be illegal inside
Canada may be proceeded against
and punished where they are found
in Canada, as if the act had been
committed there. The registered
owner, operator or PIC of an aircraft
may be proceeded against on behalf
of another person unless it was in
the possession of another person
without consent. The operator of an
aerodrome or other aviation facility
may be proceeded against on behalf
of another person unless the offence
was committed without their
consent.
You have not committed an offence
if you try as hard as possible to
prevent it.
Documents & Admin
If you hold a Canadian aviation
document, are the owner, operator
or PIC of an aircraft to which one
relates, or have one in your
possession, you must produce it to a
peace or immigration officer or the
Minister (i.e. Transport Canada)
when requested.
Unless you’re a military pilot, or a
foreign one from a contracting state,
undergoing training (with no
passengers), you must hold, and be
able to produce during your duties, an
appropriate permit, licence, rating
and medical certificate (a pilot’s
licence actually consists of three
parts – the licence itself, a radio
operator’s licence and a medical).
You cannot lend a Canadian aviation
document to anyone not entitled to
it, or allow them to use it, mutilate it,
alter it or render it illegible.
Return of Documents
You must return a Canadian aviation
document immediately after its
effective date of suspension or
cancellation.
Suspension, Cancellation, Renewal
Notices of suspension or
cancellation after a contravention must
state what the alleged contravention
was, and duration of any suspension.
The notice must be sent by personal
service, or registered or certified
mail, to your last address, and
Air Law 179
doesn’t take effect until thirty days
after it has been served or sent.
A notice of suspension issued
because of an immediate threat to
aviation safety must include the
effective date of the suspension and
the conditions under which it may
be terminated. The threat concerned
must also be specified, and, as
above, it doesn’t take effect until
thirty days after it has been served or
sent. A notice of cancellation or
suspension on medical grounds must
include the effective date and details
of the suspension, or conditions
under which it is terminated.
A request for review by a Tribunal
does not automatically stay
proceedings, but you can apply for
one in writing.
A Canadian aviation document may
also be suspended, cancelled or not
renewed if you voluntarily surrender
it, it is mutilated, altered, or rendered
illegible, the aircraft to which it
relates has been destroyed or
withdrawn, or the service to which it
relates has been discontinued.
Record Keeping
Recording systems, including
computer or microfiche, that are not
based on paper entries, must be
protected against loss, destruction or
tampering, and paper copies must be
produced on reasonable notice.
Alterations should be done so the
original entry can still be seen, with a
note as to why the alteration was
made, when and by whom.
Examinations
Unless authorized by an invigilator,
during an exam, you may not copy
or remove any portion of the text,
give it to or accept it from anyone,
give or receive help to or from
anyone, or use any aid or written
material, or you will be barred for up
to a year from a retake.
All memory must be cleared from
calculators or hand-held computers
before and afterwards in the
presence of the invigilator. The latter
must also have been specifically
designed for flight operations.
You must be competent in one of
the official languages.
Prerequisites - 401.13/421.13
You must meet standards regarding
medical fitness and identification
(that is, a permit, licence or other
official document with your
signature or photograph), with a
recommendation from the instructor
responsible for your training, plus
proper experience. Military pilots,
however, just need proof of wings. If
you have a foreign licence, a letter
is not required if you are applying
for the equivalent Canadian one, but
the paperwork must have been done
in the previous 24 months. Letters
of recommendation may only be
