Wet lease-out
(f)  Prior to the wet lease-out of an aircraft, the operator certified in accordance with this Part shall notify the competent authority.

ORO.AOC.115 Code-share agreements
(a)  Code-share agreements between an operator certified in accordance with this Part and a third country operator shall be subject to prior approval by the competent authority.
Regulation (EC) No 2111/2005 of the European Parliament and of the Council of 14 December 2005 on the establishment of a Community list of air carriers subject to an operating ban within the Community and on information air transport passengers of the identity of the operating air carrier, and repealing Article 9 of Directive 2004/36/EC, OJ L 344, 27.12.2005, p. 15.
(b)  
To obtain an approval the operator shall demonstrate to the competent authority that the third country operator:

(1)  
holds a valid AOC issued in accordance with ICAO Annex 6; and

(2)  
has established a code-share audit programme providing a system for auditing and continuous compliance monitoring.

 

(c)  
When implementing the code-share audit programme in (b)(2) the operator shall conduct an initial on-site audit and regular audits of the third country operator for the duration of the code-share agreement to ensure compliance of the third country operator with Annex IV to Regulation (EC) No 216/2008. On-site audits shall be conducted once every 24 months.

(d)  
The audits, including any findings, shall be recorded in an audit report. Level 1 findings shall be closed before entering into or continuing a code-share agreement. Level 2 findings shall be closed within 6 months after the audit. The operator shall submit all audit reports, including findings and their closure, to the competent authority. All audit reports shall be kept for at least 5years.

(e)  
The operator certified in accordance with this Part shall not sell and issue tickets for a flight operated by a third country operator when the third country operator is subject to an operating ban pursuant to Regulation (EC) No 2111/2005.

 

ORO.AOC.120 Approvals to provide Part-CC training and to issue cabin crew attestations
(a)  
When intending to provide the training course required in Part-CC, the operator shall apply for and obtain an approval issued by the competent authority. For this purpose, the applicant shall demonstrate compliance with the requirements for the conduct and content of training course established in CC.TRA.215 and CC.TRA.220and shall provide the competent authority with:

(1)  
the date of intended commencement of activity;

(2)  
the personal details and qualifications of the instructors as relevant to the training elements to be covered;

(3)  
the name(s) and address(es) of the training site(s) at which the training is to be conducted;
