(iii) A military aircraft of the same category, class, and type, if aircraft class and type are appropriate, for which the applicant is applying for a certi.cate or rating, and provided—
(A)
The aircraft is under the direct operational control of the U.S. Armed Forces;

(B)
The aircraft is airworthy under the maintenance standards of the U.S. Armed Forces; and

(C)
The applicant has a letter from his or her commanding of.cer authorizing the use of the aircraft for the practical test. * * * * *

(c)
Required controls. Except for lighter-than-air aircraft, and a glider without an engine, an aircraft used for a practical test must have engine power controls and .ight controls that are easily reached and operable in a conventional manner by both pilots, unless the Examiner determines that the practical test can be conducted safely in the aircraft without the controls easily reached by the Examiner. * * * * * [As amended by Amdt. 61–124, 74 FR 42549, Aug. 21, 2009]


Amend Section 61.51 by:
a.
Adding new paragraph (b)(3)(iv);

b.
Revising paragraphs (b)(1)(iv), (b)(2)(v), (b)(3)(iii), (e)(1), (e)(2), (e)(3), (e)(4)(ii), the heading of paragraph (g), and paragraph (g)(4); and

c.
Adding new paragraphs (j) and (k).

(iii) Simulated instrument conditions in .ight, a .ight simulator, .ight training device, or aviation training device.

 Use of night vision goggles in an aircraft in .ight, in a .ight simulator, or in a .ight training device. * * * * *

(e)

(1)
 A sport, recreational, private, commercial, or airline trans-port pilot may log pilot in command .ight time for .ights—

(i)
When the pilot is the sole manipulator of the controls of an aircraft for which the pilot is rated, or has sport pilot privileges for that category and class of aircraft, if the aircraft class rating is appropriate;

(ii)
When the pilot is the sole occupant in the aircraft;


(iii) When the pilot, except for a holder of a sport or recreational pilot certi.cate, acts as pilot in command of an aircraft for which more than one pilot is required under the type certi.cation of the aircraft or the regulations under which the .ight is conducted; or
(iv)
When the pilot performs the duties of pilot in command while under the supervision of a quali.ed pilot in command pro-vided—

(A)
The pilot performing the duties of pilot in command holds a commercial or airline transport pilot certi.cate and aircraft rating that is appropriate to the category and class of aircraft being .own, if a class rating is appropriate;

(B)
The pilot performing the duties of pilot in command is under-going an approved pilot in command training program that includes ground and .ight training on the following areas of opera-tion—

(1)
 Pre.ight preparation;

(2)
 Pre.ight procedures;

(3)
Takeoff and departure;

(4)
 In-.ight maneuvers;

(5)
 Instrument procedures;

(6)
 Landings and approaches to landings;

(7)
 Normal and abnormal procedures;

(8)
 Emergency procedures; and

(9)
 Post.ight procedures;

(C)
The supervising pilot in command holds—

(1)
A commercial pilot certi.cate and .ight instructor certi.cate, and aircraft rating that is appropriate to the category, class, and type of aircraft being .own, if a class or type rating is required; or

(2)
An airline transport pilot certi.cate and aircraft rating that is appropriate to the category, class, and type of aircraft being .own, if a class or type rating is required; and

(D)
The supervising pilot in command logs the pilot in command training in the pilot’s logbook, certi.es the pilot in command train-ing in the pilot’s logbook and attests to that certi.cation with his or her signature, and .ight instructor certi.cate number.

(e)
(2) If rated to act as pilot in command of the aircraft, an air-line transport pilot may log all .ight time while acting as pilot in command of an operation requiring an airline transport pilot certif-icate.

(3)
 A certi.cated .ight instructor may log pilot in command .ight time for all .ight time while serving as the authorized instructor in an operation if the instructor is rated to act as pilot in command of that aircraft.
