(b)
Military orders showing the person was assigned to duty outside the United States and was assigned to a U.S. Armed Forces’ operation some time between September 11, 2001, to ter-mination of SFAR 100–2; or

(c)
A letter from the person’s military commander or civilian supervisor providing the dates during which the person served outside the United States and was assigned to a U.S. Armed Forces’ operation some time between September 11, 2001, to ter-mination of SFAR 100–2.

4. Expiration date. This Special Federal Aviation Regulation No. 100–2 is effective until further notice.
[Docket No. FAA–2009–0923, SFAR No. 100–2, 75 FR 9766, March 4, 2010]

Part 91— General Operating and Flight Rules
Amend §91.703 by adding paragraph (a)(5) to read as follows:
§91.703 Operations of civil aircraft of U.S. registry outside of the United States.
(a)

(5)
For aircraft subject to ICAO Annex 16, carry on board the aircraft documents that summarize the noise operating character-istics and certi.cations of the aircraft that demonstrate compli-ance with this part and part 36 of this chapter. * * * * * [As amended by Amdt. 91–312, 75 FR 9333, March 2, 2010]

FEBRUARY 19, 2010
Effective date: April 20, 2010
Part 121—Operating Requirements: Domestic, Flag, and Supplemental Operations
Revise Section 121.344a(e) to read as follows:
§121.344a Digital .ight data recorders for 10–19 seat airplanes.
* * * * *
(e) All airplanes subject to this section are also subject to the requirements and exceptions stated in §121.344(g) through (k) and §121.346. * * * * * [As amended by Amdt. 121–347, 75 FR 7356, Feb. 19, 2010]
Add a new Section 121.346 to read as follows:
§121.346 Flight data recorders: .ltered data.
(a)
A .ight data signal is .ltered when an original sensor signal has been changed in any way, other than changes necessary to:

(1)
 Accomplish analog to digital conversion of the signal;

(2)
Format a digital signal to be DFDR compatible; or

(3)
Eliminate a high frequency component of a signal that is out-side the operational bandwidth of the sensor.

(b)
An original sensor signal for any .ight recorder parameter required to be recorded under §121.344 may be .ltered only if the

recorded signal value continues to meet the requirements of Appendix B or M of this part, as applicable.
(c)
For a parameter described in §121.344(a) (12) through (17), (42), or (88), or the corresponding parameter in Appendix B of this part, if the recorded signal value is .ltered and does not meet the requirements of Appendix B or M of this part, as applicable, the certi.cate holder must:

(1)
Remove the .ltering and ensure that the recorded signal value meets the requirements of Appendix B or M of this part, as applicable; or

(2)
Demonstrate by test and analysis that the original sensor signal value can be reconstructed from the recorded data. This demonstration requires that:

(i)
The FAA determine that the procedure and the test results submitted by the certi.cate holder as its compliance with para-graph (c)(2) of this section are repeatable; and

(ii)
The certi.cate holder maintains documentation of the proce-dure required to reconstruct the original sensor signal value. This documentation is also subject to the requirements of §121.344(i).

(d)
Compliance. Compliance is required as follows:

(1)
No later than October 20, 2011, each operator must deter-mine, for each airplane on its operations speci.cations, whether the airplane’s DFDR system is .ltering any of the parameters listed in paragraph (c) of this section. The operator must create a record of this determination for each airplane it operates, and maintain it as part of the correlation documentation required by §121.344(j)(3) of this part.

(2)
For airplanes that are not .ltering any listed parameter, no further action is required unless the airplane’s DFDR system is modi.ed in a manner that would cause it to meet the de.nition of .ltering on any listed parameter.
