ICAO should inform States of the scheduled audit period, through a published audit schedule, at least 12 months prior to the commencement of an audit. No later than nine months prior to the scheduled on-site audit, States to be audited will receive a State-specific letter from the Secretary General notifying the State of the scheduled on-site audit and requiring it to sign the specific Memorandum of Understanding (MOU). One signed copy of the MOU, along with other required information, should be returned to ICAO as soon as possible and, in any event, within three months of receiving the notification letter.
5.3.1 An ICAO Contracting State is formally notified of an audit by means of a letter signed by the Secretary General. This formal notification follows the annual audit plan forwarded to all Contracting States, and should be sent to the State at least nine months prior to the on-site audit. The accredited ICAO Regional Office will be informed of the notification to States in the region and will be requested to follow up on the process.
5.3.2 Two copies of a State-specific Memorandum of Understanding (MOU) signed by the Secretary General will be attached to the letter to the State to be audited and should be countersigned by the appropriate authority. One copy of the countersigned MOU should be returned to ICAO, at the latest within three months after receiving the notification letter.

5.4 MEMORANDUM OF UNDERSTANDING (MOU)
The State-specific MOU, based on a generic MOU approved by the ICAO Council and signed by the Secretary General and the appropriate authority of the State to be audited, represents an instrument of agreement for the conduct of the audit and follow-up action.
5.4.1 The MOU will confirm that the safety oversight audit will be conducted in accordance with the terms specified in the MOU and on the basis of the criteria contained in this manual. No safety oversight audit will be undertaken unless an appropriately signed MOU has been returned to ICAO.
5.4.2 States which have failed to sign and submit a copy of the MOU within the prescribed period shall be reported to the Council. All Contracting States will also be informed of the States’ refusal to sign an MOU and accept an ICAO safety oversight audit.
