determined under:
(a) subregulation 72A (5) of the Civil Aviation Regulations as amended by
these Regulations; or
(b) if subregulation 72A (5A) of the Civil Aviation Regulations applies to the
person—that subregulation.”
8. Regulation 20 of Statutory Rules 1991 No. 382 reads as follows:
“20. Transitional
20.1 If, immediately before the commencement of these Regulations, a designation of
an aerodrome or airspace was in force under regulation 99 or 111 of the Civil Aviation
Regulations, that designation remains in force as if it had been made under regulation 99
as in force after that commencement.
20.2 If, immediately before the commencement of these Regulations, a person held a
flight service officer licence on which a valid aerodrome flight information and alerting
rating was endorsed, the holder of the licence may, in accordance with that rating,
continue to provide, or supervise the provision of, aerodrome flight information and
alerting services for the aerodromes that were included in the aerodrome flight
information zone or zones specified in the rating.”
9. Regulation 10 of Statutory Rules 1991 No. 426 reads as follows:
“10. Savings
10.1 An aircraft maintenance engineer licence, that was issued under regulation 31 of
the Civil Aviation Regulations and in force immediately before the commencement of
these Regulations, continues in force after the commencement as if it had been issued
under regulation 31 as amended by these Regulations.
10.2 An aircraft maintenance engineer licence to which subregulation 10.1 applies
continues in force:
(a) subject to any condition to which it was subject immediately before the
commencement of these Regulations; and
(b) until the end of the period specified on the licence.

10.3 A Civil Aviation Order that was in force, or purporting to be in force, under
regulation 31 of the Civil Aviation Regulations immediately before the commencement
of these Regulations, is taken to be valid for all purposes and continues in force after the
commencement as if it had been issued under the Civil Aviation Regulations as
amended by these Regulations.”
10. Regulations 36 to 48 of Statutory Rules 1991 No. 487 read as follows:
“Interpretation
36. In this Part:
‘amended regulations’ means the Civil Aviation Regulations as amended by these
Regulations;
‘commencement’ means the commencement of these Regulations;
‘previous regulations’ means the Civil Aviation Regulations as in force immediately
before the commencement;
‘transitional period’ means the period of 6 months starting at the commencement.
Certificates of approval
37. (1) Subject to subregulation (2), subregulation 30 (2C) of the amended
regulations applies to certificates of approval whether granted before or after the
commencement.
(2) Paragraphs 30 (2C) (b) and (d) of the amended regulations do not apply to
a certificate of approval granted before the commencement until the transitional period
has ended.
Airworthiness authorities
38. A document:
(a) that was issued by the Authority before the commencement as a
maintenance authority, a welding authority, an aircraft maintenance
engineer examiner authority, a non-destructive testing authority or an
aircraft weight control authority; and
(b) that was in force immediately before the commencement;
has effect after the commencement as if it were an authority of that kind issued under
regulation 33B of the amended regulations.
Certificate of completion of activities
39. (1) If a direction under subregulation 34 (1) of the previous regulations:
(a) was in force immediately before the commencement; and
(b) could be given under subregulation 34 (1) of the amended regulations;
the direction has effect after the commencement as if it were a direction under
subregulation 34 (1) of the amended regulations.
(2) If:
(a) an approval under subregulation 34 (2) of the previous regulations was in
force immediately before the commencement; and
(b) the system of certification concerned relates to a certificate of approval
covering the maintenance of aircraft, aircraft components or aircraft
materials;

the approval has effect after the commencement as if it were an approval under
regulation 42ZG of the amended regulations.
