Requirements.In orderforparagraph(e) of this sectionto apply,the operator must submit, maintain, and adhere to aFOQAImplementation andOperationPlan that is approved by the Administrator and which contains the following elements :

(1)
Adescriptionof theoperator’splanforcollecting and analyzing.ight recorded datafromline operations on a routinebasis,includingidenti.cation ofthedata to be collected;

(2)
Procedures for taking corrective action that analysis of the data indicates is necessary in the interest of safety;

(3)
Proceduresforproviding theFAA with aggregateFOQAdata;

(4)
ProceduresforinformingtheFAAas to any corrective actionbeing undertaken pursuanttoparagraph(c)(2) of this section.

 

(d)
Submission of aggregate data. The operator will provide the FAA with aggregate FOQA data in a form and manner acceptable to the Administrator.

(e)
Enforcement. Except for criminal or deliberate acts, the Administrator will not use an operator’sFOQAdata or aggregateFOQAdatain an enforcement action against that operator or its employees when such FOQA data or aggregate FOQA data is obtained from a FOQA program that is approved by the Administrator.

(f)
Disclosure.FOQAdata and aggregateFOQAdata,if submittedin accordancewith an order designating the information as protected under part 193 of this chapter, willbe a.orded the nondisclosureprotections ofpart193 of this chapter.

(g)
Withdrawal of program approval. The Administrator may withdraw approval of a previouslyapprovedFOQAprogramforfailuretocomply with therequirementsof this chapter. Grounds for withdrawal of approval may include, but are not limited to –

(1)
Failure to implement corrective action that analysis of available FOQA data indicates is necessary in the interest of safety; or

(2)
Failure to correct a continuing pattern of violations following notice by the agency; or also

(3)
Willful misconduct or willful violation of the FAA regulations in this chapter.

FAR 21.1 : Applicability.
(a)
This Partprescribes–

(1)
Procedural requirements for the issue of type certi.cates and changes to those certi.cates; the issue of production certi.cates; the issue of airworthiness certi.cates; and the issue of export airworthiness approvals;

(2)
Rulesgoverning theholdersofany certi.catespeci.edin subparagraph(1); and

(3)
Proceduralrequirementsfor the approval of certain materials,parts,processes, and appliances.

 

(b)
Forthepurposesof thisPart,theword ”product”meansanaircraft,aircraft engine, orpropeller.In addition,for thepurposes ofSubpartL only,itincludes components and parts of aircraft, of aircraft engines, and of propellers; also parts, materials, and appliances, approved under the Technical Standard Order system.

FAR21.2 :[Falsi.cation of applications, reports, or records.]

(a)
[No person shallmake or cause to be made–

(1)
Any fraudulent or intentionally false statement on any application for a certi-.cate or approval under this part;

(2)
Any fraudulent or intentionally false entry in any record or report that is required to be kept, made, or used to show compliance with any requirement for the issuance or the exercise of the privileges of any certi.cate or approval issued under this part;
