FAR 21.435 : Application.
The applicant for a DAS authorization must submit an application, in writing and signedby an o.cial of the applicant,tothe[AircraftCerti.cationO.ce responsiblefor the geographic area] in which the applicant is located. The application must contain–
(a)
The repair station certi.cate number held by the repair station applicant, and the current ratings covered by the certi.cate;
(b)
The air carrier or commercial operator operating certi.cate number held by the air carrier or commercial operator applicant, and theproducts thatit may operate and maintain underthe certi.cate;
(c)
A statement by the manufacturer applicant of the products for which he holds the type certi.cate;
(d)
The names, signatures, and titles of the persons for whom authorization to issue supplemental type certi.cates or experimental certi.cates, or amend airworthiness certi.cates, is requested; and
(e)
A description of the applicant’s facilities, and of the sta. with which compliance
with Sec. 21.439(a)(4) is to be shown. Amdt. 21-67, E.. 10/25/89
FAR21.439 :[Eligibility.]
(a)
[To be eligible for a DASauthorization, the applicant must–
(1)
Hold a currentdomestic repair station certi.cate under Part145, or air carrier or commercial operator operating certi.cate under Part 121;
(2)
Be a manufacturer of a product for which it has alteration authority under Sec.43.3(i) of this subchapter;
(3)
Have adequate maintenancefacilities andpersonnel,intheUnitedStates, ap-propriate to the products that it may operate and maintain under its certi.-cate; and
(4)
Employ, or have available, a sta. of engineering, .ight test, and inspection personnel who can determine compliance with the applicable airworthiness requirements of this chapter.
(b)
Atleast one member ofthe sta. requiredbyparagraph(a)(4) ofthis section must have all ofthefollowingquali.cations:
(1) A thorough working knowledge of the applicable requirements of this chapter.
(2)
Aposition, onthe applicant’s sta., with authority to establish alterationpro-grams that ensure that altered products meet the applicable requirements of this chapter.
(3)
At least one year of satisfactory experience in direct contact with the FAA (oritspredecessor agency(CAA))whileprocessing engineering workfortype certi.cation or alterationprojects.
(4)
At least eightyears of aeronautical engineering experience(which may include the oneyear requiredby subparagraph(3) of thisparagraph).
(5)
The general technical knowledge and experience necessary to determine that alteredproducts, of thetypesforwhich aDAS authorizationisrequested,are in condition for safe operation.]
