9.
WARRANTIES
9.1 This clause applies to, but does not limit, all warranties required by this Agreement.
9.2 The Warranty Period in respect of a Product is two (2) years or 2,000 flying hours for Systems Warranty; and a period of seven (7) years or 5,000 flying hours for Airframe Warranty. The Warranty Period commences thirty (30) days after delivery of the aircraft from the factory to Adelaide Airport (as per Item 2.7.2 of Schedule 2)
9.3 The Supplier warrants that each Product purchased by the Customer under this Agreement:
9.3.1 is fit for its intended purpose;
9.3.2 complies with the Specifications;
9.3.3 is free from defects; and
9.3.4 operates in accordance with any relevant technical specifications (“the Warranty”).
9.4 The Customer may test the Product throughout the Warranty Period to ensure ongoing compliance with warranties given under this Agreement.
9.5 During the Warranty Period the Supplier must repair or replace any Product that fails to comply with a warranty given in this clause, at the Supplier’s cost.
9.6 Warranties which apply to the Products under this Agreement, apply to any remedial work undertaken by the Supplier, including to Products replaced or repaired by the Supplier.
9.7 The Supplier must keep the Customer indemnified against all losses, claims, costs and expenses however arising which the Customer may incur as a result of a breach of a warranty.
9.8 Any item or part which, during the Support Period, is installed in the aircraft as a consumable item or a maintenance replacement part, shall be supplied with the same warranty terms as provided by the Original Equipment Manufacturer (known as the OEM Warranty Terms) for that consumable item or part.
