Furthermore, EUROCONTROL delivered final
reports on the SES functional airspace block activity
(non-regulatory SES activity) and on all other
implementing rules still being reviewed by the SSC
(common charging scheme, airspace design).
Using another framework (special request for support),
the European Commission has requested
the support of EUROCONTROL expertise on a factual
assessment of SES implementation by
Member States and the evaluation of its impact on
ATM performance.
Conformity assessment activities
In March 2004, the Regulatory Unit and Safety
Regulation Unit jointly set up the Conformity
Assessment Task Force (CATF). Its main objective
is to encourage a harmonised approach for the
implementation of conformity assessment
processes and to propose principles for the har-

ensuring that the service provider complies initially
and over time. The NSA can issue a certificate to
provide air navigation services only to those
providers that meet the Common Requirements
(CRs) for the provision of air navigation services.
EUROCONTROL has been asked by several
stakeholders to provide support to States and air
navigation service providers faced with a lack of
resources or expertise to meet these requirements.
Consequently, the Agency has initiated the SES
Implementation Support (SESIS). This service is
twofold: support NSAs in the certification of air
navigation service providers against the common
requirements, and support service providers in
preparation for the certification. To this end, the
Agency has produced a certification manual and
guidelines in collaboration with the European
Commission and volunteer NSAs.
In practice, the implementation support will be at a
generic level, involving explanations of the guidance
material in workshops or discussion sessions,
and at an expert level, with the provision of
in-depth assistance with selected parts of the
material. These two levels of support will be provided
on the basis of the EATM Implementation
Support policy.
SAFETY REGULATION
Air traffic management (ATM) safety is fundamental
to EUROCONTROL’s existence and is its first
objective. Safety regulation provides the framework
within which ATM safety is managed. The
EUROCONTROL Safety Regulation Commission
(SRC) advises the Permanent Commission of
EUROCONTROL, through the Provisional Council,
on all matters related to the safety regulation of
ATM, and provides recommendations and specific
proposals for improvement of the safety of these
services. The SRC also assesses the overall safety
performance of the ATM system within the
European Civil Aviation Conference (ECAC) area,
with a view to identifying ATM safety levels and
trends, and areas where ATM can contribute to
overall aviation safety.
Transposition of ESARRs
into Community law
With the launch of the European Community’s
Single European Sky initiative, considerable work
on ATM safety regulation is required to ensure that
there are standard regulations across Europe.
Because not all EUROCONTROL and ECAC
Member States are members of the Community, it
is essential that the SRC works closely with the
European Commission (EC) to ensure that the
already established EUROCONTROL Safety
Regulatory Requirements (ESARRs) are transposed
into Community law and form the basis of
Community ATM safety legislation. This is in accordance
with Article 4 of the regulation on air navigation
service provision.

Certification of air navigation
service providers
The need to certify air navigation service providers
within the timescales foreseen in the common
requirements has raised significant issues regarding
the minimum arrangements needed in the
NSAs to effectively verify compliance with them. In
the safety domain, ESARR 1 defines those minimum
arrangements. The SRC has operated a task
force of States to establish a common approach to
the detailed task of certification, and the result is a
comprehensive set of ESARR advisory material
which is already being used extensively by States.
This activity has been closely coordinated with
parallel activities for certification in fields other
than safety.
Classification of ATM risks
The EC’s ATM legislative package of four SES regulations
covers the essential regulatory elements
necessary to achieve a seamless European ATM
system. The EC and European Parliament have
stressed that the participation and cooperation of
