(1)
Any .ap position other than retracted or fully extended is used to show com-pliance with the performance requirements of this part; and

(2)
The .apinstallationdoesnotmeettherequirementsofparagraph(a)(1) of this section.

 


FAR 23.701 : Flap interconnection.
(a) The main wing .aps and related movable surfaces as a system must–
(1)
[Be synchronized by a mechanical interconnection between the movable .ap surfacesthatisindependentof the .ap drivesystem; orby anapproved equi-valent means; or

(2)
Bedesigned sothattheoccurrenceof anyfailureof the .ap systemthatwould resultinanunsafe .ight characteristicoftheairplaneisextremelyimprobable; or]

(b)
Theairplanemustbe showntohavesafe .ightcharacteristicswith any combination of extremepositions ofindividual movable surfaces(mechanicallyinterconnected surfaces are to be considered as a single surface.)

(c)
If aninterconnectionis usedin multiengine airplanes,it mustbedesigned to account for the unsymmetrical loads resulting from .ight with the engines on one side of theplane of symmetryinoperativeand the remaining enginesattakeo.power.For single-engine airplanes, and multiengine airplanes with no slipstream e.ects on the .aps, it may be assumed that 100 percent of the critical air load acts on one side and 70 percent on the other.

FAR23.703 :[Takeo. warning system.]
[For commuter categoryairplanes, unless it can be shown that a lift or longitudinal trimdevicethat a.ectsthetakeo.performance of the aircraft would notgive an unsafe takeo. con.guration when selected out of an approved takeo.position, a takeo. warning system must be installed and meet the following requirements :
(a)
The system mustprovide to thepilots an aural warning thatis automatically activa-tedduring theinitialportionof thetakeo. roleif the airplaneisin a con.guration that would not allow a safe takeo.. The warning must continue until–

(1)
The con.guration is changed to allow safe takeo., or

(2)
Action is taken by the pilot to abandon the takeo. roll.

 

(b)
The means used to activate the system must function properly for all authorized takeo.power settings andprocedures and throughout the ranges of takeo. weights, altitudes, and temperatures for which certi.cation is requested.]

31.4 Landing Gear
FAR23.721 :[General.]
[For commutercategoryairplanesthathaveapassengerseating con.guration,exclu-ding pilot seats, of 10 or more, the following general requirements for the landing gear apply :
(a)
The main landing-gear system must be designed so that if it fails due to overloads during takeo.andlanding(assuming the overloadstoactintheupward andaft directions), the failure mode is not likely to cause the spillage of enough fuel from anypartof thefuel systemtoconstitutea .rehazard.

(b)
Each airplane must be designed so that, with the airplane under control, it can be landed on a paved runway with any one or more landing-gear legs not extended without sustaining a structural componentfailure thatislikely to cause the spillage of enough fuel to constitute a .re hazard.

(c)
Compliancewith theprovisionsof this sectionmaybe shownby analysisortests, or both.]

FAR 23.723 : Shock absorption tests.
(a)
It must be shown that the limit load factors selected for design in accordance with Sec. 23.473 for takeo. and landing weights, respectively, will not be exceeded. This must be shown by energy absorption tests except that analysis based on tests conducted on alandinggear system withidentical energy absorption characteristics may be used for increases in previously approved takeo. and landing weights.
