Operation of a launch site means the conduct of approved safety operations at a permanent site to support the launching of vehicles and payloads.
Payload means an object that a person undertakes to place in outer space by means of a launch vehicle, including components of the vehicle specifically designed or adapted for that object.
Person means an individual or an entity organized or existing under the laws of a state or country.
State and United States when used in a geographical sense, mean the several States, the District of Columbia, the Commonwealth of Puerto Rico, American Samoa, The United States Virgin Islands, Guam, and any other commonwealth, territory, or possession of the United States; and
United States citizen means:
a. Any individual who is a citizen of the United States;
(b)
 Any corporation, partnership, joint venture, association, or other entity organized or existing under the laws of the United States or any State; and

(c)
 Any corporation, partnership, joint venture, association, or other entity which is organized or exists under the laws of a foreign nation, if the controlling interest in such entity is held by an individual or entity described in paragraph (a) or (b) of this definition. Controlling interest means ownership of an amount of equity in such entity sufficient to direct management of the entity or to void transactions entered into by management. Ownership of at least fifty-one percent of the equity in an entity by persons described in paragraph (a) or (b) of this definition creates a rebuttable presumption that such interest is controlling.

This part prescribes the procedures applicable to all applications submitted under this chapter to conduct licensed activities. These procedures apply to applications for issuance of a license, transfer of an existing license and renewal of an existing license. More specific requirements applicable to obtaining a launch license or a license to operate a launch site are contained in parts 415 and 417 of this chapter, respectively.
§ 413.3 Who must obtain a license.
(a)
 Any person must obtain a license to launch a launch vehicle from the United States or a license to operate a launch site within the United States.

(b)
 An individual who is a United States citizen or an entity organized or existing under the laws of the United States or any state must obtain a license to launch a launch vehicle outside of the United States or a license to operate a launch site outside of the United States.

(c)
 A foreign entity in which a United States citizen has a controlling interest, as defined in section 401.5 of this chapter, must obtain a launch license to launch a launch vehicle from or a license to operate a launch site within—

(1)
 Any place that is both outside the United States and outside the territory of any foreign nation, unless there is an agreement in force between the United States and a foreign nation providing that such foreign nation shall exercise jurisdiction over the launch or the operation of the launch site; or

(2)
 The territory of any foreign nation if there is an agreement in force between the United States and that foreign
