4.2 Operational certification
and supervision
4.2.1 The air operator certificate
4.2.1.1 An operator shall not engage in commercial air
hansport operations unless in possession of a valid air operator
certificate or equivalent document issued by the State of h e
Operator.
4.2.1.2 The air operator certi.ficate or cquivalcnt ilocuinen t
shall authorize the opcrator to conduct co~mnercial air transport
operations in accordance with such conditions and
limitations as may be specified.

3.2.1.6 The State of the Operator shall establish a system
for both the certification and the continued surveillance of the
operator to ensure that the required standards of operations
established in 4.2 are maintained.
4.2.2 Operations manual
4.2.2.1 An operator shall provide, for the use and
guidance of operations personnel concemcd, an operations
manual in accordance with Appendix 2. The operations
rnanual shall be amended or revised as is necessary to ensure
that the infonnauon cot~tained therein is kept up to date. A11
such amendments or revisions shall bc issued to all personnel
that are requirzd to use this manual.
4.2.2.2 The State of the Operator shall establish a requirement
for the operator to provide a copy of the operations
nmnual together wilh all amendments and/or revisions, for
review and acceptance and, where required, approval. The
operator shall illcorporate in the opcrations manual such
mandatory material as the State of the Operator lnay rcquirc.

4.2.3.3 Recommendation.- The operutor should issrie

conditions arrd intended rake-off technique. This information

4.2.4 In-flight simulation of emergency situations
An opcrntor shall ensure that when passengers or cargo are
being carried, no emergcncy or abnormal situations shall he
sinlulated.
4.2.5 Checklists
The checklists provided in accordance with 6.1.3 shall be used
by flight crews prior to, during and after all phases of
operations. and in Emergency, to ensurc compl~ance with the
operating procedures contained in the aircraft operating manual
and the aeroplane flight manual or other documents associated
with the certificate of airworthiness and otherwise in the
operations manual, arc followed. The design and utilization of
checklisls shall observe Human Factors principles.
